Australian prosecutors have urged an appeal court to keep mushroom killer Erin Patterson in prison for the rest of her life, describing her crimes as “truly dreadful.” Patterson was sentenced to life imprisonment after being convicted of murdering three relatives and attempting to murder another by serving them a meal containing deadly death cap mushrooms.

The prosecution has challenged Patterson’s sentence, arguing that the 33-year minimum term before she can seek parole is far too lenient given the seriousness of the crimes. At the same time, Patterson’s lawyers are appealing her convictions and seeking to have them overturned.

Erin Patterson Mushroom Murder Case

The case dates back to July 2023, when Patterson hosted a lunch at her home in Victoria, Australia. She served her guests a beef Wellington that prosecutors said contained death cap mushrooms.

Her former parents-in-law, Don and Gail Patterson, both 70, and Gail’s sister, Heather Wilkinson, 66, later died after becoming seriously ill.

Heather’s husband, Ian Wilkinson, survived the poisoning but has never fully recovered from the effects of the meal, prosecutors told the Court of Appeal in Melbourne.

Patterson, now 51, attended the appeal hearing by video link from prison.

Prosecutors Say Patterson Betrayed Her Family

Prosecutors argued that the severity of Patterson’s crimes went beyond the deaths themselves. They described the incident as a profound betrayal of people who had trusted her and had supported her and her children over many years.

According to the prosecution, the poisoning was not an impulsive act. They said Patterson had spent months preparing for the attack, including obtaining enough death cap mushrooms to poison her guests and creating a false explanation for what happened.

Prosecutors also highlighted Patterson’s behaviour during the lunch.

They said she watched as her guests ate the poisonous meal while continuing normal conversation. The meal reportedly ended with a prayer for Patterson after she told the guests that she had been diagnosed with cancer.

Patterson Did Not Reveal the Mushrooms

After her guests became critically ill, Patterson did not tell police or medical workers that the meal contained foraged mushrooms.

Prosecutors said she continued to maintain her account even after she knew that some of the victims were on life support.

They argued that her actions showed the seriousness of the offending and justified a sentence that would prevent her from ever being released.

Why Prosecutors Want a Longer Sentence

Patterson was sentenced last year to life imprisonment with a minimum non-parole period of 33 years.

At the time, Justice Christopher Beale said there was a possibility that Patterson could eventually be released. He cited the harsh conditions she could face in prison, including the possibility of spending years in solitary confinement because of her notoriety and for her own protection.

Prosecutors have challenged that reasoning.

They argued that Patterson’s prison conditions are likely to improve over time as public attention surrounding the case decreases. During the hearing, prosecutor Brendan Kissane also described some of the activities available to Patterson in prison, including access to an exercise yard and hobbies such as crocheting.

If the court does not agree with the prosecution’s request for a sentence without parole, prosecutors have asked judges to increase the minimum term.

They argued that 33 years is “manifestly inadequate” and does not properly reflect the seriousness of the crimes or the loss suffered by the four victims.

Patterson’s Lawyers Challenge Her Convictions

The sentencing appeal is only one part of the legal battle.

Patterson’s lawyers are also seeking to overturn her convictions, arguing that problems during her original trial may have resulted in a miscarriage of justice.

Her legal team has pointed to what they described as a “catastrophic” mix-up involving the jury. Jurors stayed at the same hotel as prosecutors and a key witness during the trial.

They have also argued that some evidence presented to the jury was too speculative and should not have been admitted.

Prosecutors have rejected those arguments and defended the original trial.

When Will the Court Decide?

The Victorian Court of Appeal has heard arguments from both sides but has reserved its decision.

That means the judges are expected to announce their ruling at a later date. It could take weeks or months before the court decides whether Patterson’s convictions will stand and whether her sentence should be changed.

For now, Erin Patterson remains in prison as both sides await the outcome of the appeals.
